1. General
Upon purchasing a seat on a ONEAIR JET flight, a contract is established, outlining specific rights and obligations for each party as detailed below. ONEAIR JET, located at 4325 SOUTH FOX STREET, ENGLEWOOD, CO 80110, serves as the authorized Public Charter operator ("ONEAIR JET") under 14 CFR Part 380. The trip price, outbound and return flight dates, origin and destination cities, and other conditions are specified in the corresponding ONEAIR JET itinerary or your accepted reservation and are incorporated herein by reference. Unless otherwise stated, the price includes only air transportation.
2. Reservations & Payments
Reservations must be made directly with ONEAIR JET. Within seven days, ONEAIR JET will review your travel document (government-issued photo ID) and pet details. If approved, you will be notified that your payment has been accepted and that you are cleared to travel. Refer to Sections 5 and 6 for cancellation terms. A reservation is not confirmed until full payment is received. If there is an issue, you will be notified by email that your reservation was not accepted.
YOUR PAYMENT GOES DIRECTLY TO ONEAIR JET'S PUBLIC CHARTER DEPOSITORY (ESCROW) ACCOUNT. YOUR ENTIRE PAYMENT AMOUNT IS ALSO PROTECTED BY A SECURITY AGREEMENT BETWEEN ONEAIR JET AND ACSTAR INSRUANCE COMPANY. You must file a claim with ONEAIR JET or ACSTAR INSURANCE COMPANY within 60 days of your arrival or intended arrival date if the charter is canceled. After this period, the security company is released from all liability under the security agreement.
3. Air Transportation
ONEAIR JET flights are operated by Global Air Charters, or a comparable air carrier, using Gulfstream G-IV/G-IVSP/G-V aircraft with seating capacity for up to ten (10) passengers or similar aircraft. Global Air Charters provides air transportation in accordance with all applicable laws and regulations governing commercial air transportation. ONEAIR JET AND GLOBAL AIR CHARTERS RESERVE THE RIGHT TO SUBSTITUTE ANOTHER DULY LICENSED CARRIER AND/OR TO CHANGE THE TYPE OF AIRCRAFT, ITS CAPACITY, AND ROUTING; NO REFUND WILL BE PROVIDED FOR SUCH SUBSTITUTIONS OR CHANGES, UNLESS SUCH CHANGES CONSTITUTE A MAJOR CHANGE (AS DEFINED HEREIN). Consumer protections afforded to Public Charter passengers shall apply only to those passengers who actually travel on a Public Charter flight and/or pay ONEAIR JET for services contemplated hereunder. Tickets issued or procured by ONEAIR JET are neither endorsable to other carriers nor usable on alternate routes of the same carrier. Flight dates and times are not guaranteed.
4. Check-In Information
Please refer to your itinerary or flight briefing for check-in information. Passengers are required to present themselves for check-in at least sixty (60) minutes prior to the scheduled departure time. Failure to be present at the boarding area at least thirty (30) minutes before the scheduled departure will result in being classified as a “no-show,” and your seat may be allocated to a standby passenger. In such cases, neither ONEAIR JET nor Global Air Charters (or the applicable direct air carrier) shall bear responsibility or liability for your transportation. For further details on no-shows, please refer to Paragraph 6 below.
5. Cancellations by ONEAIR JET and Major Changes
Trip Cancellation more than 28-days before departure:
ONEAIR JET reserves the right to cancel a trip for any reason, provided ONEAIR JET notifies you in writing within seven (7) days after the cancellation occurs but no later than twenty eight (28) days before the scheduled departure date. A full refund will be made within fourteen (14) days after such cancellation.
Trip Cancellation less than 28 days before departure:
ONEAIR JET WILL NOT CANCEL A TRIP LESS THAN TWENTY-EIGHT (28) DAYS BEFORE DEPARTURE EXCEPT FOR CIRCUMSTANCES BEYOND ITS CONTROL THAT MAKE IT PHYSICALLY IMPOSSIBLE TO PERFORM THE TRIP, INCLUDING BUT NOT LIMITED TO FORCE MAJEURE EVENTS (SEE SECTION 11). IF SUCH A CIRCUMSTANCE OCCURS, ONEAIR JET WILL NOTIFY YOU AS SOON AS POSSIBLE, AND IF THE TRIP IS CANCELLED, ONEAIR JET WILL REFUND ALL MONIES WITHIN FOURTEEN (14) DAYS.
“Major Change(s)” to a trip
IF ONEAIR JET MAKES A PRE-DEPARTURE “MAJOR CHANGE” TO A TRIP, YOU MAY CANCEL UP TO TWENTY-FOUR (24) HOURS BEFORE DEPARTURE AND RECEIVE A FULL REFUND WITHIN FOURTEEN (14) DAYS AFTER CANCELLATION. Only the following constitute “Major Change(s):” (i) a change in the departure or return date unless the change results from a flight delay experienced by the air carrier, although a delay of longer than forty-eight (48) hours will always be considered a “Major Change;” (ii) a change in the origin or destination city; or (iii) a price increase of more than ten (10) percent occurring ten (10) or more days before departure. If a “Major Change” occurs, ONEAIR JET will notify you within seven (7) days after learning of the change but, when possible, at least ten (10) days before the scheduled departure. If ONEAIR JET first knows of the “Major Change” less than ten (10) days before departure, ONEAIR JET will notify you as soon as possible. IF A “MAJOR CHANGE” WHICH YOU ARE UNWILLING TO ACCEPT OCCURS AFTER YOUR OUTBOUND FLIGHT HAS BEEN COMPLETED, ONEAIR JET WILL REFUND, WITHIN FOURTEEN (14) DAYS AFTER YOUR SCHEDULED RETURN DAY, THAT PORTION OF YOUR PAYMENT WHICH APPLIES TO THE SERVICE NOT PROVIDED.
6. Cancellations by Passenger & Itinerary Changes and Refunds
IF YOU CANCEL OR CHANGE A CONFIRMED RESERVATION, OR IF YOU “NO-SHOW” FOR A FLIGHT, YOUR RIGHT TO A REFUND, EXCEPT AS PROVIDED IN SECTION 5 FOR MAJOR CHANGES OR OPERATOR CANCELLATIONS, IS LIMITED AS FOLLOWS: Except as otherwise provided for herein, all reservations that are received are non-refundable, unless ONEAIR JET notifies you by email advising that your reservation was not accepted. If you cancel or change your reservation, no refund will be due. If you “no-show” for a flight, we will consider that a passenger cancellation; and no refund will be due. ANY REFUND, IF APPLICABLE, WILL BE MADE WITHIN FOURTEEN (14) DAYS AFTER THE DATE OF CANCELLATION. If, at time of cancellation, a passenger provides a substitute participant (which a passenger may do subject to ONEAIR JET’s approval, such approval not to be unreasonably withheld) utilizing the same itinerary, a full refund less a $25 administrative fee will be provided. ONEAIR JET may, at its discretion, provide a substitute participant if seats are available, subject to the same refund terms.

7. Amenities in the Event of Flight Delay
ONEAIR JET shall not be responsible for providing amenities in the event of a flight delay. ONEAIR JET may, at its sole discretion, offer hotel accommodations, meal and drink vouchers, ground transportation, and other amenities to passengers affected by a flight delay.
8. Baggage Allowance and Liability
Checked baggage allowance is 50 lb per seat purchased for all trips. This can be made up of more than bag. In addition, each seat purchased can also bring one small carry-on item (similar in size to a purse, laptop bag, compact rucksack) in the aircraft cabin. TSA requires that passengers are allowed to bring one small bag of liquids, aerosols, gels, creams, and pastes through the checkpoint with your carry-on bag. These are limited to 3.4 ounces or less per container. All luggage must comply with aircraft capacity, weight limitations, and safety regulations. The flight crew has sole discretion to approve or deny any items that exceed storage capacity or pose a safety risk to the flight. Any removed/rejected baggage remains the sole responsibility of passenger. ONEAIR JET will not transport bags causing the plane to exceed weight limits, nor will it facilitate the shipment of excess baggage. Passengers are solely responsible for arranging the shipping of any excess baggage. ONEAIR JET and Global Air Charters (and/or the applicable direct air carrier) neither assume nor accept liability for lost, delayed, or damaged bags.
9. Responsibility
ONEAIR JET IS THE PRINCIPAL AND IS RESPONSIBLE FOR MAKING THE ARRANGEMENTS TO PROVIDE THE SERVICES INCLUDED IN THE TRIP. IN ALL CASES, TRANSPORTATION IS SUBJECT TO ALL THE TERMS AND CONDITIONS OF THE RESPECTIVE CARRIER’S APPLICABLE TARIFF AND/OR CONTRACT OF CARRIAGE. ACCORDINGLY, YOU HEREBY AGREE THAT, EXCEPT AS OTHERWISE PROVIDED HEREIN, AND EXCEPT IN THE CASE OF ONEAIR JET’S NEGLIGENCE, ONEAIR JET IS NOT RESPONSIBLE OR LIABLE FOR ANY LOSS, INJURY, EXPENSE, DAMAGE TO PROPERTY OR PERSONAL SICKNESS, INJURY, OR DEATH TO YOU, OR ANY ANIMAL YOU TRANSPORT ON A FLIGHT, INCLUDING THOSE THAT RESULT DIRECTLY OR INDIRECTLY FROM (A) AN ACT OR OMISSION OF ANY AIR CARRIER OR OTHER TRAVEL SUPPLIER, OR (B) ANY OTHER CAUSE OR ACT, OF WHATSOEVER NATURE, BEYOND THE DIRECT AND IMMEDIATE CONTROL OF ONEAIR JET, INCLUDING DUE TO THE ACTIONS OR INACTIONS OF OTHER PASSENGERS AND/OR THEIR PETS/ANIMALS. YOU MAY SEEK RECOURSE FROM OTHER PASSENGERS OR PET/ANIMAL OWNERS FOR INJURIES CAUSED BY THEIR PETS/ANIMALS, OR THEIR ACTIONS OR INACTIONS, SUBJECT TO APPLICABLE LAW. YOU ARE RESPONSIBLE FOR ANY DAMAGE TO THE AIRCRAFT, ANOTHER PASSENGER, OR ANOTHER PASSENGER’S PET/ANIMAL OR PROPERTY CAUSED BY YOU OR ANY PET/ANIMAL YOU TRANSPORT ON A FLIGHT, AND YOU SHALL INDEMNIFY AND HOLD HARMLESS ONEAIR JET FROM ANY SUCH DAMAGE. YOU AGREE TO PAY FOR ANY REPAIRS OR CLEANING (INCLUDING THOSE CAUSED BY SCRATCHES, STAINS, OR CONTAMINATION) CAUSED BY YOU OR ANY PET/ANIMAL YOU TRANSPORT INCLUDING THE COSTS OF ANY DEEP CLEANING WHICH MAY BE REQUIRED. EXCEPT AS OTHERWISE SPECIFIED HEREIN, IN THE EVENT OF NON-OPERATION OF ANY FLIGHT DUE TO REASONS BEYOND THE CONTROL OF ONEAIR JET, ONEAIR JET’S SOLE LIABILITY SHALL BE TO REFUND TO YOU THAT PORTION OF THE PRICE ALLOCABLE TO THE SERVICES NOT PROVIDED. ANY DEVIATION FROM THE TRIP THAT YOU INITIATE IS SOLELY YOUR RESPONSIBILITY.
ONEAIR JET SHALL NOT BE LIABLE FOR ANY DAMAGE, LOSS, EXPENSE, OR OTHER IRREGULARITY CAUSED BY THE DEFECT OF ANY VEHICLE OR CONVEYANCE, OR THE ACTS, OMISSIONS, OR NEGLIGENCE OF ANY AIR CARRIER OR OTHER THIRD-PARTY ENGAGED IN CONVEYING THE PARTICIPANT OR CARRYING OUT THE ARRANGEMENTS FOR ANY TRIP.
Any flight may be governed by the International Convention for the Unification of Certain Rules Relating to International Carriage by Air as amended (the “Warsaw Convention”) as amended and supplemented and/or by the rules and regulations established by the Montreal Convention on the Unification of Certain Rules for International Carriage signed in Montreal on 28th May 1999 (“the Montreal Convention”) which rules and limitations shall, to the extent such Warsaw Convention and/or the Montreal Convention is/are applicable, apply to any Flight(s) conducted by the air carrier.
10. Identification and Travel Documents
UPON BOOKING YOU MUST SUBMIT A COPY OF YOUR GOVERNMENT-ISSUED PHOTO IDENTIFICATION AND BRING THIS WITH YOU ON THE DAY OF TRAVEL. THIS DOCUMENT MUST MATCH FULLY THE PASSENGER MANIFEST. FAILURE TO PROVIDE THE CORRECT IDENTIFICATION WILL LEAD TO A DELAYED DEPARTURE OR TO DENIAL OF BOARDING. PLEASE BE SURE TO HAVE SUCH IDENTIFICATION AND ALL REQUIRED TRAVEL DOCUMENTS READY WHEN YOU CHECK IN. ONEAIR JET shall not be liable for any damage, loss, expense, or other irregularity caused by you failing to provide the correct identification and travel documents. You are responsible for obtaining all necessary travel documents (passport, visa, tourist card, immunization certificate, and any other documents as required) and for complying with the laws of each country from, through, or to which you receive transportation. You agree to indemnify ONEAIR JET for any loss, damage, or expense suffered or incurred by reason of your failure to comply with this Section 10.
11. Force Majeure
ONEAIR JET shall have no liability or responsibility for any failure or delay in the performance of its obligations under this agreement due directly or indirectly to Force Majeure. A Force Majeure means other than the lack of the availability of adequate financial resources, any events, circumstances or causes beyond the party’s reasonable control including but not limited to the following: acts of God, flood, earthquake, windstorm or other natural disaster; quarantine, epidemic or pandemic, crew sickness; terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; nuclear, chemical or biological contamination or sonic boom; compliance with any law or governmental order, rule, regulation or direction, or any action taken by a government or public authority, including but not limited to imposing an embargo, export or import restriction, quota or other restriction or prohibition, or failing to grant a necessary license or consent; fire, explosion or accidental damage; adverse weather conditions; interruption or failure of utility service, including but not limited to electric power, fuel or gas; non-performance by suppliers or subcontractors; and any labor or trade dispute, strikes, industrial action or lockouts. If a flight cannot be performed or completed due to a Force Majeure event, ONEAIR JET’s sole obligation will be to refund to you any amount of money paid in connection with a cancelled flight. Notwithstanding the foregoing, ONEAIR JET WILL NOT CANCEL A TRIP LESS THAN TWENTY-EIGHT (28) DAYS BEFORE DEPARTURE, EXCEPT FOR CIRCUMSTANCES BEYOND ITS CONTROL THAT MAKE IT PHYSICALLY IMPOSSIBLE TO PERFORM THE TRIP, INCLUDING BUT NOT LIMITED TO FORCE MAJEURE EVENTS DESCRIBED IN THIS SECTION 11.
12. Pet Safety Requirements\Travel Requirements for Pets
All Passengers must travel with, and have immediate access to, a muzzle suitable for their dog(s)/animal(s) at all times. The muzzle will need to be shown at check-in and must be worn by the passenger’s dog(s)/animal(s) if requested by either a ONEAIR JET representative or by the flight crew, whether before boarding or in flight. Passengers must comply with this instruction for the safeguarding of their dog/animal and others. Failure to comply will result in denied travel.
If your dog/animal is noted as assertive\aggressive at the booking stage (in the discretion of ONEAIR JET), ONEAIR JET will contact you by email to ascertain more information and may require a subsequent travel suitability assessment, carried out by a veterinarian and\or ONEAIR JET’s pet partner at the passenger’s sole cost and expense.
Dogs must always be on leash at all times, including within the airport terminal and onboard the aircraft.
Cats must travel and remain in their carriers at all times.
13. Pet Documentation for Travel
If the destination you are travelling to requires pet travel documentation to enter, this is the full responsibility of the owner. ONEAIR JET can refer you to resources on what is required, as well as refer you to preferred pet partners, but compliance with all laws and completion of any paperwork is the full responsibility of the owner. ONEAIR JET shall not be liable for any damage, loss, expense, or other irregularity caused by ONEAIR JET providing such resources and referrals or by you failing to know, understand, and comply with any and all applicable laws relating to required pet travel documentation.
ONEAIR JET will request, at various stages before departure, copies of the required pet travel documentation, and, where applicable, these will be sent to the relevant authorities for pre-departure approval.
Failure to supply correct pet travel documentation will result in denied travel, and no refund will be due.
You agree to indemnify ONEAIR JET for any loss, damage, or expense suffered or incurred by reason of your failure to comply with this Section 13.
14. Notices
All communication should be sent to ONEAIR JET at the address shown in Paragraph 1 above, or by email to info@oneairjet.com. Notices to ONEAIR JET are effective upon actual receipt by ONEAIR JET.
15. Applicable Law
This contract is governed by and shall be construed under the laws of the State of Colorado.
16. Miscellaneous
ONEAIR JET reserves the right to amend this contract without notice to the passenger so long as such amendment is in compliance with applicable governmental regulations or waivers thereof. THE RIGHTS AND REMEDIES MADE AVAILABLE UNDER THIS CONTRACT ARE IN ADDITION TO ANY OTHER RIGHTS OR REMEDIES AVAILABLE UNDER APPLICABLE LAW; HOWEVER, ACCEPTANCE OF A REFUND FURNISHED UNDER THIS CONTRACT SHALL CONSTITUTE A WAIVER OF SUCH OTHER RIGHTS AND REMEDIES. PARTICIPANT AGREES THAT UNDER NO CIRCUMSTANCES SHALL ONEAIR JET BE LIABLE TO PARTICIPANT FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES IN CONNECTION WITH THIS AGREEMENT AND/OR THE SERVICES PROVIDED BY ONEAIR JET HEREUNDER, WHETHER IN CONTRACT OR TORT (INCLUDING STRICT LIABILITY AND NEGLIGENCE) INCLUDING LOSS OF REVENUE, LOSS OF USE, OR ANTICIPATED PROFITS.
17. Insurance
Trip cancellation, health, and accident insurance is available for purchase by all passengers from third-party vendors. Options for such insurance can be sent to you upon request.
18. Operational Control
The air carrier shall be responsible for the operation of the aircraft and the safe performance of each flight and shall retain full operational control and possession of the aircraft to enable it to do so. The captain of the aircraft has absolute discretion as to when and whether any flight should be undertaken and when and whether the aircraft should be landed and whether or not he or she refuses to transport any passenger, baggage, animal or cargo. The passenger agrees to accept all decisions made by the captain and hereby shall waive all claims against the operator, ONEAIR JET and their respective servants and agents for any loss, damage or costs of any nature and in any way that arise, whether in contract or tort or otherwise as a result of such decision, except that ONEAIR JET’s sole liability shall be to refund to you that portion of the price, if applicable, allocable to the services not provided.
In the event that you are refused entry at any arrival airport, you shall indemnify and keep indemnified ONEAIR JET, against any and all liabilities, costs, expenses, damages and losses (including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs and all other reasonable professional costs and expenses) incurred by ONEAIR JET in respect of any arrangements made by the air carrier and/or ONEAIR JET to return you to the country from which were originally carried.
Neither party may assign this contract without the express written consent of the other party.
Participant hereby represents, warrants, and agrees that: (i) Participant is not a sanctioned individual, “designated party,” or otherwise the subject or target of any economic, export, or trade sanction law, or regulation or travel ban, or is or could be designated as a terrorist, a foreign terrorist organization, an organization that assists or provides support to a foreign terrorist organization, a proliferator of weapons of mass destruction, a narcotics trafficker, or any other similar designation that would prohibit Participant from transacting with ONEAIR JET under applicable law; (ii) Participant will promptly notify ONEAIR JET in writing should it know, or have reason to know, of any change or potential change in status under this provision; (iii) funds paid to ONEAIR JET by Participant are not derived from illegal acts; and (iv) ONEAIR JET may be required by law to block, freeze, and/or remit funds, which it will do without liability to Participant.
19. Air Charter Broker Services
For any services where ONEAIR JET arranges air transportation as an air charter broker under 14 CFR Part 295, rather than as a Public Charter operator under 14 CFR Part 380, ONEAIR JET acts solely as an intermediary and does not operate aircraft. Such services are provided by Global Air Charters or another duly licensed direct air carrier and ONEAIR JET has no operational control over the aircraft or flight operations.
